{"id":37470,"date":"2024-02-06T09:41:58","date_gmt":"2024-02-06T08:41:58","guid":{"rendered":"https:\/\/www.eli-beams.eu\/?page_id=37470"},"modified":"2024-04-04T14:04:57","modified_gmt":"2024-04-04T12:04:57","slug":"information-on-the-protection-of-whistleblowers","status":"publish","type":"page","link":"https:\/\/www.eli-beams.eu\/about\/information-on-the-protection-of-whistleblowers\/","title":{"rendered":"Information on the protection of whistleblowers"},"content":{"rendered":"<p>In accordance with Act No. 171\/2023 Sb., on the protection of whistleblowers (hereinafter referred to as the \u201cWhistleblower Protection Act\u201d), the ELI ERIC (hereinafter referred to as the \u201cEmployer\u201d) provides protection to whistleblowers working at Employer\u2019s premises.<\/p>\n<p>The text below is only a short summary. The Employer recommends to all whistleblowers to familiarize themselves with the Whistleblower Protection Act, which regulates rights and duties of the whistleblowers, employers, competent persons (and other persons) including whistleblowing procedures.<\/p>\n<p><strong>What illegal conduct can be reported?<\/strong><\/p>\n<p>A\u00a0whistleblower may provide information about possible illegal conduct that has occurred or is about to occur at Employer\u2019s premises, and which<\/p>\n<ul>\n<li>has the elements of a\u00a0criminal offence<\/li>\n<li>is an offence for which a\u00a0fine of 100,000 CZK or more may be imposed, or<\/li>\n<li>violates the Wistleblower Protection Act, another legal regulation of the Czech Republic or a\u00a0regulation of the European Union in the areas of public procurement, personal data protection, privacy and security of electronic communication networks and information systems and in other areas under Sec. 2\u00a01) (d) of the Wistleblower Protection Act.<\/li>\n<\/ul>\n<p><strong>What notifications are excluded?<\/strong><\/p>\n<p>In particular, knowingly false notifications, i.e.\u00a0notifications of information that the wistleblower had no reasonable grounds to believe was true, are excluded from the protection. Notifications containing classified information or information which when reported could immediately endanger an essential security interest of the Czech Republic are also excluded from the protection.<\/p>\n<p><strong>Who is a\u00a0whistleblower?<\/strong><\/p>\n<p>A\u00a0natural person who performs or performed work or other similar activities for the Employer, even indirectly (e.g.\u00a0employee, student, intern,) may become a\u00a0whisteblower.<\/p>\n<p>Persons who do not perform a work or other similar activity under Section 2 paragraph 3 letter a), b), h) or i) of the Whistleblower Protection Act are hereby in accordance with Section 9 paragraph 2 letter a) of the Whistleblower Protection Act excluded from the possibility of becoming a whistleblower, i.e. the Employer shall not accept notifications from such persons.<\/p>\n<p><strong>How can a\u00a0notification be made?<\/strong><\/p>\n<p>A\u00a0notification can be filed:<\/p>\n<div>Through the Employer\u2019s\u00a0internal notification system, either\u00a0in writing at\u00a0<a id=\"OWAc6898d32-460f-a7a8-f6b1-4c0d0ff52f32\" class=\"x_x_OWAAutoLink\" href=\"http:\/\/www.nntb.cz\/c\/bg9tmg4n\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-loopstyle=\"linkonly\" data-linkindex=\"3\">www.nntb.cz\/c\/bg9tmg4n<\/a>, or by telephone or in person by prior arrangement with the competent person (Sec. 9\u00a0of the Whistleblower Protection Act).<\/div>\n<div>\u00a0The competent person, who receives and handles notifications, is Ji\u0159\u00ed Kubricht, phone +420727874447<\/div>\n<p><strong>When will a\u00a0notification be processed?<\/strong><\/p>\n<p>A\u00a0whistleblower who has submitted a\u00a0notification through the Employer\u2019s internal notification system must receive<\/p>\n<ul>\n<li>a\u00a0confirmation that the notification was received within 7\u00a0calendar days, and<\/li>\n<li>information on how the notification has been assessed no later than 30 days after receipt of the notification. In complex cases, the deadline for investigation can be extended twice by 30 days (to a\u00a0total of 90 days).<\/li>\n<\/ul>\n<p><strong>How is the whistleblower&#8217;s\u00a0person protected?<\/strong><\/p>\n<p>In connection with the submission of a\u00a0notification, the Employer ensures:<\/p>\n<p><strong>Protection of the identity of the whistleblower<\/strong><\/p>\n<p>Only the competent person has access to notifications; information about the identity of the whistleblower can only be disclosed with the written consent of the whistleblower or if another legal provision so provides.<\/p>\n<p><strong>Protecting a\u00a0whistleblower from retaliation<\/strong><\/p>\n<p>In connection with a\u00a0reasonably made notification (filed either through the Employer\u2019s\u00a0internal reporting system or through the Ministry), a\u00a0whistleblower or other protected person must not be subjected to retaliation, i.e.\u00a0such conduct in relation to the whistleblower&#8217;s\u00a0work or other similar activity that could cause harm to the whistleblower or other protected person.<\/p>\n<p><em>The terms and conditions of whistleblower protection are governed by the Whistleblower Protection Act that implements the Directive (EU) 2019\/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In accordance with Act No. 171\/2023 Sb., on the protection of whistleblowers (hereinafter referred to as the \u201cWhistleblower Protection Act\u201d),&#8230;<\/p>\n","protected":false},"author":4,"featured_media":0,"parent":20344,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":[],"_links":{"self":[{"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/pages\/37470"}],"collection":[{"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/pages"}],"about":[{"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/types\/page"}],"author":[{"embeddable":true,"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/users\/4"}],"replies":[{"embeddable":true,"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/comments?post=37470"}],"version-history":[{"count":2,"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/pages\/37470\/revisions"}],"predecessor-version":[{"id":38034,"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/pages\/37470\/revisions\/38034"}],"up":[{"embeddable":true,"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/pages\/20344"}],"wp:attachment":[{"href":"https:\/\/www.eli-beams.eu\/wp-json\/wp\/v2\/media?parent=37470"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
